Terms of Service

By downloading, installing, or using the Persist mobile application (“the App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and Persist.

Persist is a mobile iOS application designed to help independent life insurance agents manage client relationships, track policy retention, and monitor commission goals. The App provides tools including:

• A weekly task list based on client birthdays, policy anniversaries, and renewal dates
• A retention score reflecting the health of your client book
• A commission goal tracker
• Client profile management and search
• Smart push notifications for upcoming client events

Persist is intended for professional use by licensed insurance agents and is not a CRM, financial planning tool, or compliance system. You are solely responsible for how you use the information within the App.

Access to Persist requires a paid subscription after a 30-day free trial. The trial begins on the date you create your account and provides full access to all features. No credit card is required to start the trial.

Subscription plans are:

• Monthly: $10.00 per month
• Annual: $100.00 per year (equivalent to $8.33/month)

All payments are processed through the Apple App Store and managed via RevenueCat. By subscribing, you authorize Apple to charge your Apple ID account on a recurring basis at the applicable rate. Prices are in USD and may vary by region as determined by Apple.

Subscriptions automatically renew at the end of each billing period unless canceled at least 24 hours before the renewal date. You can manage or cancel your subscription at any time through your Apple ID account settings.

Your 30-day free trial gives you full access to all features of Persist at no charge. At the end of the trial period, continued use of the App requires a paid subscription. If you do not subscribe, your access to the App will be restricted.

Free trials are available to new accounts only. We reserve the right to limit or revoke trial access if we determine it is being used fraudulently or in violation of these Terms.

You may cancel your subscription at any time through your Apple ID account settings. Cancellation takes effect at the end of the current billing period — you will retain full access to the App until that date.

We do not offer refunds for partial billing periods. If you cancel an annual subscription mid-year, you will retain access through the end of the annual period but will not receive a prorated refund. Refund requests related to App Store purchases are subject to Apple's refund policies.

You agree to:

• Provide accurate information when creating your account
• Keep your login credentials confidential and not share them with others
• Use the App only for its intended purpose — managing your own client relationships as a licensed insurance professional
• Ensure that you have the legal right to store the client information you enter into the App
• Comply with all applicable laws and regulations, including those governing client data privacy in your jurisdiction

You may not use Persist to:

• Store data for clients who have not consented to having their information recorded digitally
• Engage in any activity that violates applicable law or regulation
• Attempt to reverse engineer, decompile, or extract the source code of the App
• Use automated tools, bots, or scripts to interact with the App
• Share, resell, or sublicense access to the App to third parties
• Use the App in any way that could harm, disable, or impair our systems or other users

All content, features, and functionality of Persist — including but not limited to the design, code, text, graphics, and branding — are owned by Persist and protected by applicable intellectual property laws. Nothing in these Terms grants you any right to use our trademarks, logos, or brand elements without our prior written consent.

You retain ownership of all client data you enter into the App. By using the App, you grant us a limited license to process and store that data solely for the purpose of providing the service to you.

Persist is provided “as is” and “as available” without warranties of any kind, either express or implied. We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We make no guarantees regarding the accuracy or completeness of the task lists, retention scores, or any other outputs generated by the App.

The App is a productivity tool, not a compliance system. You are solely responsible for your professional obligations, client relationships, and any regulatory requirements in your jurisdiction.

To the fullest extent permitted by law, Persist and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including loss of commissions, client relationships, or business data — arising from your use of or inability to use the App.

Our total liability to you for any claim arising from these Terms or your use of the App shall not exceed the amount you paid for the App in the twelve months preceding the claim.

These Terms are governed by the laws of the United States. Any disputes arising under these Terms shall be resolved in the courts of competent jurisdiction in the United States. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We reserve the right to modify these Terms at any time. When we make material changes, we will update the “Last updated” date and notify you via email or an in-app notice. Continued use of the App after changes are posted constitutes your acceptance of the updated Terms.
